White House Announces New Proclamation Restricting Entry of H-1Bs

On September 19, 2025, the White House issued a proclamation, "Restriction on Entry of Nonimmigrant Workers" which prohibits the entry of H-1B workers outside of the US and also suspends the processing of H-1B petitions filed on behalf of beneficiaries outside of the US, absent a payment of $100,000. This proclamation is slated to go into effect on September 21, 2025 (12:01am ET) and last for 12 months. 

As written, the proclamation does not impact those currently in the US in H-1B status.

No specific details related to how the White House will administer or enforce this proclamation have been provided.

We expect this decision to be challenged in federal court. Until further information is available, we advise all H-1B holders to remain in the US. Those outside of the US with a valid H-1B visa should return before the proclamation goes into effect.
