Federal Court Strikes Down Trump Administration's $100,000 H-1B Fee

This is a follow up to our June 8, 2026, article regarding the $100,000 H-1B Fee Proclamation.

On June 24, 2026, the First Circuit Court of Appeals ruled against the Trump administration in declining to pause a district court ruling that deemed the fee illegal and unconstitutional. As such, the $100,000 fee which already had very limited application, remains completely blocked.

Although the Trump administration may further appeal, the $100,000 fee was already set to expire on September 19, 2026. Given the litigation challenges, the administration may not try to renew the fee.
