USCIS Confirms H1B Cap Selection Process
USCIS has confirmed that the registration period for FY 2023 H-1B cap cases will begin on March 1st at 9 AM (Pacific Time), and end on March 18th at 9 AM (Pacific Time). During this period, prospective petitioners, or their legal representatives, must use a myUSCIS online account to register each H1B beneficiary electronically for the selection process (also referred to as the “H1B lottery”) and pay the associated $10 H1B registration fee for each registration submitted on behalf of each beneficiary.
After the registration period ends on March 18th, USCIS will randomly select registrations and send selection notifications via myUSCIS online accounts. Selection notifications will be completed by March 31st.
An H1B cap-subject petition, including a petition for a beneficiary who is eligible for the advanced degree exemption, may only be filed by a petitioner whose registration for the beneficiary named in the H1B petition was selected in the H-1B registration process.
Note: H1B petitions filed for someone who is in, or has held, H1B status are not subject to this selection process (e.g., H1B extension petitions, change of employer petitions). Also, H1B petitions filed by certain types of employers are not subject to this selection process (e.g., higher education institutions, non-profit affiliated with a higher education institution, and non-profit research or government organizations).
