As of December 4, 2009, approximately 61,100 H-1B cap-subject petitions had been filed.

With the 20,000 H-1Bs for applicants with advanced US degrees already exhausted, there appears to be no more than 3,200 H-1Bs available (as of December 4th) for the current fiscal year. With filings against the cap continuing to pick-up in pace, the cap may be reached by mid-December and will almost certainly be reached before the end of the month.

Note: the estimate of 3,200 is based on report that USCIS will only set-aside 700 H-1Bs for Chileans and Singaporeans. By regulation, 6,800 H1Bs are to be set-aside, but because usage by Chileans and Singaporeans never comes close to the 6,800 limit, USCIS is reportedly only setting aside 700 H-1Bs
