USCIS Not Accepting December Visa Bulletin’s “Date for Filing” Chart for Employment-Based I-485s

At least for December 2015, USCIS is not accepting employment-based adjustment of status applications (I-485s) unless the applicant is current based on the “final action” chart. Essentially, USCIS has dismissed the “date for filing” chart in Department of State’s December 2015 Visa Bulletin which would have enabled applicants born in India, China and the Philippines to file their I-485s sooner.

For family-based cases, USCIS is accepting I-485s based on the more-favorable “dates for filing” chart.
