USCIS Confirms Denial of Pending Advance Parole Applications Due To International Travel

In reversal of long-standing policy, USCIS has started denying applications for advance parole (AP) if the applicant travels internationally while the AP application is pending.  In the past, USCIS has approved AP renewal applications for individuals who travel abroad during the pendency of the application with a valid AP or a valid H, K, L, or V visa.

The American Immigration Lawyers Association (AILA) is in liaison discussions with USCIS to push for reversal of this sudden policy change.  ILG will monitor this issue and update as soon as more information becomes available.

In the meantime, applicants should avoid international travel during the pendency of the AP application or consider resubmitting a new application if the pending application is denied.
