H-1B Cap Update: 62,900 as of 12/11/09 - Up Another 1,800 from 12/04/09

As of December 11, 2009, approximately 62,900 H-1B cap-subject petitions had been filed.

With the 20,000 H-1Bs for applicants with advanced US degrees already exhausted, there appears to be only 1,400 H-1Bs available (as of December 11th) for the current fiscal year. It appears the cap will be reached by the end of this week.

Note: the estimate of 1,400 is based on report that USCIS will only set-aside 700 H-1Bs for Chileans and Singaporeans. By regulation, 6,800 H1Bs are to be set-aside, but because usage by Chileans and Singaporeans never comes close to the 6,800 limit, USCIS is reportedly only setting aside 700 H-1Bs.
