H-1B Cap Update: 54,700 as of November 6, 2009 (Up 900 from October 30, 2009)

As of November 6, 2009, approximately 54,700 H-1B cap-subject petitions have been filed. With the 20,000 advanced degree H-1Bs already exhausted and 6,800 H-1Bs set aside for Chileans and Singaporeans, there are only approximately 3,500 H-1Bs available for the current fiscal year (ending September 30, 2010).

At this rate, the H1B cap may be reached in late November or early December.

For companies planning to file cap-subject H-1Bs, please note that the Labor Condition Application, which must be submitted to the Department of Labor at least one week before an H1B petition can be filed with USCIS, time is of the essense for cap-subject H-1B filings.
