H-1B Cap Update

June 19, 2009

USCIS announced that as of June 12th, approximately 44,400 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

Interestingly, the latest count of 44,000 is less than the count of 45,800 on May 29th. Given the fact many of the earlier filed H-1B cap cases have already been adjudicated and USCIS' increasing scrutiny on H-1B petitions particularly by IT consulting companies, it is unclear whether the count was reduced due to denials and/or due to findings of duplicate filings.
