USCIS Offers Premium Processing For Certain I-140 Petitions

Starting June 16, 2008, USCIS will begin accepting Premium Processing for Form I-140 for certain H-1B workers reaching the end of their sixth year in H-1B status. To qualify you must:

• Currently be in H-1B status
• Will reach the 6th year of your H-1B stay in 60 days
• Are only eligible for a further H-1B extension with an approved I-140, under AC21 Section 104(c)
• Are ineligible to extend your H-1B status under AC21 Section 106(a)
