May 7, 2007

USCIS reported that the FY2008 H-1B cap for U.S. Master's or PhD degree holders was reached on April 30, 2007. Accordingly, petitions received on April 30, 2007 will go through to a computer generated random selection process, and filings not randomly selected will be return along with the filing fees unless another basis for an H-1B cap exemption exists.

USCIS will reject U.S. Master's H-1B petitions received on or after May 1, 2007 unless another basis for an H-1B cap exemption exists.
