As of December 3, 2010, USCIS has received the following number of H-1Bs that count against the annual H-1B cap:
- Regular: 51,200. Up 800 from the previous week (11/26/10)
- Master's: 18,700. Up 300 from the previous week (11/26/10)
Based on recent rate of filing, the master's cap may be reached around the end of December or January, while the regular cap may be reached in the latter half of January or February.
The "regular" H-1B cap is limited to 65,000 per year, but up to 6,800 H-1Bs may be set aside per US-Chile and US-Singapore free trade agreements.
The "advanced US degree" cap is 20,000 per year. Once the advanced US degree cap is reached, beneficiaries with US advanced degrees may still apply against the regular cap until that is also exhausted.
