The cut-off dates for EB-2 India and China advanced 1 full year from the January Visa Bulletin, to January 1, 2010.

 

EB-3 dates moved much more modestly: one week for India, 1.5 months for China and 3 weeks for all other EB-3 countries of chargeability.

 

As previously noted EB-2 cut-off dates have advanced at a rapid rate since September.  This action was intended to generate significant levels of new adjustment of status filings in an attempt to generate demand and maximize usage under the annual limit. The Department of State had recently reported that it may aggressively move the cut-off date for January (and possibly beyond), and now it has.  However, readers are once again advised that an eventual need to retrogress the cut-off date is also a distinct possibility.

 

ILG maintains accurate record all clients’ priority dates and will diligently and proactively reach out to clients who are eligible to file for AOS in February.  ILG ask clients to bear in mind the significant advancement of dates and refrain from unnecessary inquiries so that we may work quicker for all our valuable clients.
