EB-5 Program Extended Through September 30, 2016 Without Change

After months of speculation, uncertainty, and a flurry of last-minute proposed changes, Congress extended the EB-5 program through September 30, 2016 without any changes. 

 

The next opportunity to reform the EB-5 program will be October 1, 2016.  The changes most likely to be made include increasing the investment amount from $500,000 to $800,000; more complex Targeted Employment Area definition and job creation methodology; and more program oversight and scrutiny.  Additionally, retroactive application of new law is a possibility.
