DOL Resumes LCA and PERM Processing
This is an update to our October 1st alert regarding the Government Shutdown.
The Department of Labor today announced that it has resumed processing of Labor Condition Applications (LCA), prevailing wage requests, and PERM labor certifications. As such, the Office of Foreign Labor Certification’s (OFLC) Foreign Labor Application Gateway (FLAG) system is now accessible and permits system users to prepare and submit new applications.
OFLC is actively prioritizing and processing applications that were previously delayed, which is critical for businesses that need to hire foreign workers through programs like PERM and H-1B.
It is not known how long OFLC will continue to operate given the ongoing federal government shutdown. Currently, ILG is prioritizing the filing of all LCAs and PERMs and will continue to monitor this situation and provide further updates as they become available.
