Concerns Over Misuse of the B-1 Visa Program

Concerns Over Misuse of the B-1 Visa Program
May 26, 2011

The Department of State (DOS) sent a May 13, 2011, letter to Senator Grassley in response to the Senator's concerns over alleged misuse of the B-1 visa program. DOS states that it is working with Department of Homeland Security (DHS) to "consider removing or substantially amending" the B-1 in lieu of H-1B provision.

DOS explains that consular officers in India, in cooperation with DOS' Office of Fraud Prevention Programs and DHS, have taken concrete steps to combat illegal work performed while in B-1 status. DOS further reports that at one consulate, the net refusal rate for B-1 visa has increased by 25 percent. Also, five large employers have been suspended from the "Business Executive Program," a program which facilitates expedited visa processing for employees of certain companies. Employees of those companies now face particularly close scrutiny.
