China & India EB-2 Will Retrogress

Charlie Oppenheim, Chief of Visa Control at the State Department, has confirmed that, effective March 23, 2012, no further EB-2 employment-based green cards will be issued for China-mainland born and India applicants with priority dates of August 15, 2007, or later.

 

Through the end of April, USCIS will continue to accept I-485 applications for applicants with priority dates prior to the cut-off date established in the April 2012 Visa Bulletin (May 1, 2010), but those cases with priority dates of August 15, 2007, or later, will be and held in a "pending" status until new employment-based green cards numbers are available beginning FY2013 on October 1, 2012.  Mr. Oppenheim advises that an item in the soon to be released May Visa Bulletin will address the EB-2 movement.
