What documents do we need to provide for an H-1B transfer?

You will need to provide key documents such as your company’s information (FEIN, tax returns, etc.), the employee's current H-1B approval notice (I-797), recent pay stubs, and a valid passport copy. We’ll guide you through the full list to ensure nothing is missed.

How long does the H-1B transfer process take, and when can my employee start working?

The H-1B transfer process typically takes 1-4 months, depending on whether premium processing is used. The good news is that your employee can start working with you as soon as the transfer petition is filed with USCIS, provided they are currently in valid H-1B status.

What is the H-1B cap, and how does the lottery process work?

The H-1B cap is an annual limit on the number of new H-1B visas issued each year, currently set at 65,000 regular cap visas and an additional 20,000 for U.S. advanced degree holders. The lottery process randomly selects petitions from the pool of registrants, and if your candidate is selected, we will file the full H-1B petition to secure their visa.

When should we start preparing for the H-1B cap season?

 

  • It’s crucial to begin preparing well in advance. We recommend starting the process in January, as the registration period for the H-1B cap typically opens in March. Early preparation ensures we gather all necessary documentation and submit a strong application for the lottery.
